1. About these terms

HomeCrowd ("HomeCrowd", "we", "us", "our") is operated by TBS Shaw Ventures Pty Ltd (ABN [ABN]), trading as HomeCrowd Australia.

These Terms of Use govern your access to and use of homecrowd.com.au and any related pages, tools and services (the "Platform"). By using the Platform you agree to these terms. If you do not agree, please do not use the Platform.

We may update these terms from time to time. The current version will always be published on this page, and the "last updated" date will change. Continuing to use the Platform after a change means you accept the updated terms.

2. What HomeCrowd is — and what it is not

HomeCrowd is a hyperlocal information directory. For each suburb we bring together business listings, community events, local clubs and groups, public facilities, and information sourced from government and other public data feeds.

Importantly:

  • We are an information platform, not a party to any transaction between you and a business, club, event organiser or other user.
  • We do not endorse, vet, guarantee or supervise the businesses, services, clubs, events or people listed on the Platform.
  • We are not an emergency service. Never rely on HomeCrowd in an emergency — call 000.

3. Eligibility and your account

You must be at least 16 years old to submit content, claim a listing, or provide us with an email address. If you are under 18, you should have a parent or guardian's permission.

You are responsible for keeping any access credentials secure and for all activity conducted through your email address or listing.

4. Third-party and public data — accuracy limits

Substantial parts of the Platform display information sourced from third parties, including (without limitation) government open data, utility providers, transport authorities, weather services, news publishers, mapping providers and commercial data suppliers.

This includes information such as waste and recycling collection days, power and water outages, roadworks and traffic disruptions, public transport stops and services, weather observations and warnings, school locations and catchment areas, parks and public facilities, property sale records, business details and ratings, and news headlines.

We do not create, verify or control this information. It is provided on an "as is" and "as available" basis. It may be incomplete, out of date, delayed, interrupted, or incorrect.

You must not rely on the Platform where accuracy matters. In particular:

  • Waste collection — confirm with your local council before relying on a collection date.
  • Power, water and telecommunications outages — confirm with the relevant provider. In an emergency involving fallen powerlines, call the provider's emergency number or 000.
  • School catchments — catchment boundaries change and are determined by the relevant education authority. Confirm directly with the school and the Department of Education before making any decision, including any decision to buy or rent a property.
  • Property sale information — indicative only, may be incomplete or contain errors, and is not a valuation, an appraisal, or financial or investment advice.
  • Transport information — confirm timetables and service status with the operator.
  • Weather and warnings — always refer to the Bureau of Meteorology and emergency services for current warnings.

Where a third-party source requires attribution or imposes conditions, we display those where practicable. Third-party data remains the property of its owner and is subject to that owner's terms.

5. Business listings

5.1 Free and paid listings

Some listings appear because a business is publicly listed and locally relevant. Others are claimed, enhanced or paid for by the business. Where a listing is paid, promoted or featured, we will identify it as such.

5.2 Claiming a listing

If you claim a listing, you warrant that you are authorised to act for that business. We may require you to verify your email address or provide further evidence. We may decline, suspend or remove a claim at our discretion.

5.3 Accuracy of listing content

If you supply listing content, you are responsible for its accuracy and for ensuring it complies with all applicable laws, including the Australian Consumer Law and any professional advertising rules that apply to your industry.

5.4 Health and regulated professions

Listings for registered health practitioners and health services are subject to the advertising restrictions in the Health Practitioner Regulation National Law, as administered by Ahpra. Consistent with those restrictions, we do not display consumer ratings or reviews on health practitioner and health service listings. If you believe a listing breaches those rules, contact us and we will act promptly.

5.5 Removal

You may request removal of a listing about your business at any time by contacting us. We may also remove or decline any listing at our discretion.

6. User-generated content

The Platform allows users to submit content, including community events, notice board posts, lost and found posts (including photographs), club and group suggestions, votes and poll responses, and messages sent through our contact relay.

6.1 Your responsibilities

When you submit content, you warrant that:

  • it is accurate, lawful, and not misleading;
  • you own it or have the right to submit it;
  • it does not infringe anyone's intellectual property, privacy or other rights;
  • it is not defamatory, harassing, threatening, discriminatory, obscene, or otherwise objectionable;
  • it does not contain another person's personal information without their consent;
  • it does not contain malware, spam, or unsolicited commercial content; and
  • it does not misrepresent a lost or found item, animal or person.

6.2 Licence you grant us

You retain ownership of what you submit. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt (for formatting), publish and display that content on the Platform and in connection with promoting the Platform. You can end this licence for a specific item by asking us to remove it, subject to reasonable technical delays and any copies retained for legal or backup purposes.

6.3 Moderation and removal

We are not obliged to monitor user content, but we may review, edit, refuse or remove any content at any time, with or without notice. We will act promptly on credible complaints — see clause 10.

6.4 Contact relay and personal safety

Where the Platform allows users to contact one another (for example, about a lost pet), messages are relayed without disclosing the recipient's email address. We do not verify the identity of any user. Exercise the same caution you would with any stranger: meet in public places, do not share sensitive personal or financial information, and do not attend a private address alone.

7. Games and interactive features

The Platform includes daily games and community polls. These are provided for entertainment. Results, statistics, streaks and rankings are stored on your device and, where relevant, aggregated anonymously on our servers. We may change, reset or discontinue any game at any time. No prize, reward or monetary value attaches to any result.

8. Acceptable use

You must not:

  • use the Platform for any unlawful purpose;
  • scrape, harvest, crawl, index or otherwise extract data from the Platform by automated means without our prior written consent;
  • copy, reproduce or republish any substantial part of our directory or database;
  • interfere with, overload or attempt to gain unauthorised access to the Platform or its infrastructure;
  • impersonate any person or business;
  • submit content on behalf of a business without authority; or
  • use the Platform to send unsolicited commercial messages.

9. Intellectual property

The Platform, including its design, layout, source code, compilation of listings, editorial content, branding and the HomeCrowd name and logo, is owned by TBS Shaw Ventures Pty Ltd or licensed to us, and is protected by copyright and trade mark law.

Our directory is a compilation created through substantial effort. Copying it, in whole or in substantial part, infringes our rights.

Nothing in these terms transfers any of our intellectual property to you.

10. Complaints, takedowns and copyright

If you believe content on the Platform is inaccurate, unlawful, defamatory, infringes your rights, or discloses your personal information, contact us at nick@homecrowd.com.au with:

  • your name and contact details;
  • the exact page or listing concerned;
  • what the issue is; and
  • what outcome you are seeking.

We will acknowledge your complaint and respond within a reasonable time, and will remove or amend content where appropriate.

11. Disclaimers and liability

11.1 Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded.

11.2 To the extent permitted by law

Subject to clause 11.1, and to the maximum extent permitted by law:

  • the Platform and all content are provided "as is" and "as available", without warranties of any kind;
  • we do not warrant that the Platform will be uninterrupted, error-free, secure, or that any information on it is accurate, complete or current;
  • we are not liable for any loss or damage arising from your use of, or reliance on, the Platform or any content on it, including content supplied by third parties or other users;
  • we are not liable for any dealings between you and any business, club, event organiser or other user; and
  • our total liability to you for all claims is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

We are not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill.

12. Indemnity

You agree to indemnify us against any claim, loss, damage, cost or expense (including reasonable legal costs) arising from your breach of these terms, your content, or your use of the Platform, except to the extent caused by our own negligence or breach.

13. Suspension and termination

We may suspend or terminate your access to the Platform, or remove your content or listing, at any time and without notice, if we reasonably believe you have breached these terms or that doing so is necessary to protect the Platform or other users.

14. Privacy

Our collection and handling of personal information is described in our Privacy Policy, which forms part of these terms.

15. General

  • Governing law. These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
  • Severability. If any provision is found unenforceable, it is severed and the remainder continues in force.
  • No waiver. A failure to enforce any provision is not a waiver of it.
  • Entire agreement. These terms, together with the Privacy Policy, are the entire agreement between you and us about the Platform.
